JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.5 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in S.C.No.1103/2017 (Crime No.21/2014) of Hanumanthanagar Police Station, Bengaluru pending on the file of LXI Additional City Civil and Sessions Judge, Bengaluru registered for offences punishable under Sections 392 and 411 of Indian Penal Code. 2. Heard learned counsel for petitioner and learned High Court Government Pleader for respondent - State. - 3 - HC-KAR NC: 2025:KHC:40859 CRL.P No. 11749 of 2025 3. Learned counsel for petitioner would contend that, the petitioner has been granted bail by this Court. The petitioner was not appearing in the Sessions case. He remained absent twice and got recalled NBW issued against him. On the third time, NBW was issued against him and he has been secured by executing the Warrant and he is remanded to judicial custody. The petitioner is in judicial custody since last nine months, he is the only bread earner of the family. With these, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader would contend that, the case registered against the petitioner relates to the incident which took place in the year 2014. Even though, the petitioner was on bail, he remained absent twice. He got recalled NBW issued against him twice. Due to the said act of the petitioner, the said case registered against him in the year 2018 is still pending. The petitioner is habitual offender and he is involved in fifteen cases in different police stations with - 4 - HC-KAR NC: 2025:KHC:40859 CRL.P No. 11749 of 2025 similar offences. If the petitioner is granted bail, he will again abscond and delay the trial. The petitioner is a rowdy sheeter and he may tamper the prosecution witnesses. On these grounds, he prayed for dismissal of the petition. 5. Having heard the learned counsels appearing for the parties, this Court has perused the charge sheet records, order passed by the Sessions Court and other materials placed on record. 6. The accused is facing trial for offence under Sections 392 and 411 of Indian Penal Code in S.C.No.1103/2017 on the file of LXI Additional City Civil and Sessions Judge, Bengaluru. The incident is of the year 2014. The case registered against the petitioner has been split up due to his absence in the original case. The petitioner who had been granted bail by this Court, without abiding by the conditions, he remained absent twice and he got recalled the NBW issued against him twice. The petitioner again remained absent and by - 5 - HC-KAR NC: 2025:KHC:40859 CRL.P No. 11749 of 2025 executing the NBW, he has been secured and he is remanded to judicial custody. The case registered against the petitioner is eight years old and incident has been taken place about eleven years ago. The petitioner is stated to have been involved in fifteen criminal cases of similar offences registered by different police stations. If the petitioner is granted bail, again he may abscond and he will cause delay in trial of the case registered against him. 7. Considering the above aspect, the petitioner has not made out any grounds for grant of trial. In the result, this Criminal Petition is dismissed.
