The present bail application has been moved by the applicant- accused Mukul @Sunil for the offence punishable under Sections 2/3 Gangster Act & Anti Social Activities Prevention Act, 1986, in Case Crime No. 171 of 2007, Police Station-Niwari, District Ghaziabad. 2. Mr. Ayush Kaushik, learned advocate, appears on behalf of applicant and submits that accused-applicant has been granted bail by the court below vide order dated 13.03.2008. This is a case of jumping of bail, due to which N.B.W. has been issued and was arrested. The applicant had regularly appeared before the court below till 30.11.2015 thereafter for earning livelihood he went outside the district and absconded in trial.The accused-applicant is in jail since 09.05.2025. 3. Per contra, learned AGA has opposed the prayer for bail and submitted that the accused-applicant is habitual offender. 4. Taken into consideration the rival submissions made by the parties and perused the record. 5. The perusal of the record reveals that the accused-applicant has been granted bail on 13.03.2008 by the court below in the matter of Gangster Act but on account of jumping of bail, N.B.W. has been issued during the trial. The accused-applicant has surrendered before the court wherein he was taken into custody and his bail application is rejected due to long absent from the trial. Learned counsel for the applicant assures the Court that accused-applicant will appear in the trial if he is released on bail. Consider that the accused-applicant is ready to face the trial. The accused-applicant is in jail since 09.05.2025. Without touching the merit of the case, this bail application is allowed. 6. Let the accused applicant be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
