This Application has been filed by the applicant-Faheem Ahmad seeking anticipatory bail in Case Crime No.205 of 2025, registered at Police Station Jaspur, District Udham Singh Nagar under Sections 115(2), 123, 351(2), 352, Section 85 of the Bharatiya Nyaya Sanhita, 2023, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 1 2025:UHC:6049 2. The First Anticipatory Bail Application of the applicant was dismissed on 21.05.2025 as withdrawn granting liberty to him to file a fresh anticipatory bail application. 3. According to the First Information Report dated 15.05.2025, the applicant is the husband of the informant’s sister. He harasses her demanding dowry. On 14.05.2025, he beat her and poisoned her. 4. Heard Mr. Harshpal Sekhon, learned counsel for applicant, Mr. Tumul Nainwal, learned A.G.A. for State and Mr. Kaushal Sah Jagati, learned counsel for informant and victim. 5. The informant’s sister, the victim, is present in-person. She is identified by Mr. Kaushal Sah Jagati, Advocate. She submitted that her date of birth is 09.05.1994 and her marriage was solemnized with the applicant on 17.03.2021. However, Mr. Kaushal Sah Jagati, Advocate, has opposed the anticipatory bail application. 6. Mr. Tumul Nainwal, learned A.G.A., has opposed the anticipatory bail application orally. 7. Mr. Harshpal Sekhon, Advocate, submitted that the informant’s sister, who is present in-person, is the wife of the applicant. All the allegations are false. 2 2025:UHC:6049 Applicant does not have any criminal antecedents. He is a permanent resident of District Udham Singh Nagar, therefore, there is no chance of his absconding. He was granted interim bail on 09.06.2025, and, the conditions of the interim bail have not been violated by him. 8. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present Application, filed for anticipatory bail, is allowed and order dated 09.06.2025, granting interim bail to the applicant, is made absolute. It is directed that in the event of arrest of the applicant Faheem Ahmad, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/- and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions:- (i) Applicant shall cooperate with the Investigating Agency and he shall make himself available for interrogation by a police officer as and when required; (ii) If the charge-sheet is filed, the applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; 3 2025:UHC:6049 (iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iv) Applicant shall not leave the country without the previous permission of the trial court. 9. It is made clear that if the applicant misuses or violates any of the conditions, imposed upon him, the prosecution agency will be free to move the Court for cancellation of the anticipatory bail. ___________________ ALOK KUMAR VERMA, J.
