Heard learned counsel Mr. J.P.Gogoi for the petitioner Lokeshwar Goyari who has filed this application under Section 482 of the BNSS, 2023 praying for pre-arrest bail apprehending his arrest in connection with Udalguri P.S. Case No. 126/2024 under Sections 112(2)/318(4)/267 of BNS, 2023. 2. The gist of this case in brief is that on 20.10.2024, one Kajal Tanti had Page No.# 2/2 lodged an FIR before the Officer-in-Charge of Udalguri Police Station, inter-alia, alleging that the accused persons named in the FIR, have organized a lottery in the name of development of Bhima Sankar Shiva Mandir located at No. 1, Sapkhaiti and it is alleged that they have cheated the purchaser of the lotteries by falsely declaring the results on 20.10.2024. It is also alleged that the petitioner has embezzled crores of rupees by announcing fake results. 3. The learned counsel for the petitioner has submitted that the allegations levelled in the FIR t are not true. He submits that the results of the lottery were declared duly on 20.10.2024. 4. I have considered the submissions at the bar with circumspection. I have also scrutinized the Case Diary. It appears that the petitioner has appeared before the I.O. and has co-operated with the investigation. His statement has been recorded and he has not violated the bail condition. 5. Considering all the aspects, the interim bail granted to the petitioners on 13.02.2025 is hereby made absolute. 6. Send back the Case Diary. 7. The Anticipatory Bail application stands disposed of.
