Neutral Citation No. - 2025:AHC:118925-DB Court No. - 29 Case :- WRIT - C No. - 22440 of 2025 Petitioner :- Suresh Chandra Respondent :- The, Project Director, National Highway And 2 Others Counsel for Petitioner :- Kamla Singh,Vijay Shanker Singh Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J.
1. Heard Mrs. Kamla Singh, learned counsel for the petitioner,
learned counsel for the National Highway Authority of India, Mr. Devesh Vikram Singh, learned Additional Chief Standing Counsel for the State-respondents and perused the material brought on the record.
2. The instant writ petition under Article 226 of the Constitution of India has been filed directing the respondent-Authority to release the compensation amount against the acquired land of petitioner i.e. area 0.0700 hect., from the Khata No.698, Gata No.372, acquired by the NHAI under Section 3(g) (3) by the gazette and notification dated 22.03.2012 and bearing letter No.226/ST dated 05.08.2013 as well as to consider the report of SDM Akbarpur, Kanpur Dehat dated 14.01.2019 and report dated 25.01.2023 submitted by the competent Authority.
3. After arguing at some length, learned counsel for the petitioner has confined his prayer only to the extent that appropriate direction may be issued to the respondent No.2 to take a final call upon the representation dated 13.05.2025 preferred by the petitioner within stipulated time as this Court may fix.
4. Confronted with the above situation, learned counsel for the contesting-respondents very fairly conceded the fact that if the representation filed by the petitioner has not been decided till date, definitely, the respondent-Authority shall decide the same in accordance with law.
5. Be that as it may, no useful purpose would be served in keeping the writ petition pending consideration. Without adverting on the merits of the case, the writ petition, on consent, is disposed of with a direction to respondent No.2 i.e. District Magistrate, District- Kanpur Nagar to take a final call upon the representation dated 13.05.2025 so filed by the petitioner within a period of eight weeks, strictly in accordance with law, but certainly after giving audience to all the stake holders in the matter from the date of production of certified copy of this order.
