In view thereof, the present petition shall be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996 and shall be decided by the Arbitral Tribunal. Accordingly, it is directed that the present petition be placed before the Sole Arbitrator to be heard and adjudicated as an application under Section 17 of the Act.
