Heard the parties.
The petitioner has been made accused in connection with S.T. Case No.636 of 2024, arising out Nirsa P.S. Case No. 201 of 2024, corresponding to G.R. case No.1988 of 2024, for the offences registered under Sections 399 & 402 of the Indian Penal Code and Sections 25(1-B)(a)/26/35 of the Arms Act, pending in the court of learned Additional Sessions Judge-XVI, Dhanbad. On 27.06.2024, Nirsa Police on the basis of confidential information that some unknown criminals had assembled near Don Bosco School and were making preparation of committing dacoity, raided the place of occurrence and apprehended the co-accused persons. On search, one country made pistol and eleven live cartridges were recovered from the possession of the co-accused. It was submitted that though the petitioner is named in the F.I.R., but his name has come in confession of co-accused. It was further submitted that similarly situated co-accused persons have been granted bail by this Court earlier.
Considering the fact that nothing incriminating was recovered from the possession of the petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-XVI, Dhanbad, in connection with S.T. Case No.636 of 2024, arising out Nirsa P.S. Case No. 201 of 2024, corresponding to G.R. case No.1988 of 2024.
