The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 719/2024, registered 2 at Police Station Ambikapur, District-Surguja (CG) for the offence punishable under Section 103(1) and Section 238 of BNSS, 2023. 2. The prosecution story in brief, is that, on 16.10.2024 at about 9:30 am, the dead body of deceased namely Hari Lakda was found in a shrub of Nepal Lodge Gali which was seen by complainant Chanchal Singh and thereafter merg was recorded against unknown person and during the merg enquiry on the basis of the statement made by complainant Chanchal Singh the FIR has been lodged against the present applicant in the offence punishable under Section 103(1) and 238 of BNSS, 2023 have been registered against him. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is residing in his house nearby the place of occurrence where the dead body was found, due to this reason he has falsely been implicated in the alleged crime on the basis of the CCTV footage which was not linked with the crime in question. The applicant is in jail since 16.10.2024, charge sheet has been filed and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Karandeep Singh involved in Crime No. 719/2024 under Section 103(1) and Section 238 of BNSS, 2023 at Police Station-Ambikapur, District- Surguja, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8.
