The present writ petition has been filed by the petitioner to quash impugned order/ letter : 165/S.D.M./Supply/2001 dated 18.09.2021 passed by the Respondent No. 2/ Sub-Divisional Magistrate, Hasanpur, District- Amroha. 2. A preliminary objection has been raised by the learned Standing Counsel appearing on behalf of Respondents that against aforesaid order, statutory alternative remedy is available to the petitioner to file an appeal before the Commissioner of Division as provided under Sub-Section 1 of Section 13 of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 3. In this view of the matter, the writ petition is dismissed on the ground of availability of statutory alternative remedy. 4. Certified copy of order which is appended along-with the petition, office is directed to return the same to the learned counsel for the petitioner, after keeping the photocopy of the same.
