Neutral Citation No. - 2025:AHC:112657-DB Court No. - 29 Case :- WRIT - C No. - 22110 of 2025 Petitioner :- Ankit Chaudhary And Another Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Mithilesh Kumar Tiwari Counsel for Respondent :- C.S.C.,Shiv Prakash Gupta Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioners, learned A.C.S.C., and learned counsel for Meerut Development Authority. 2. The instant writ petition has been preferred for a direction commanding the respondents no. 2 and 3 to allot the commercial plot No.LMCP-08 area 262.50 sq. mtrs. situated at MDA Shradhauri Phase-2 Housing Scheme, Sector and Pocket C, Meerut in favour of the petitioners, as they are the highest bidder of the aforsaid commercial plot in the e-auction dated 02.04.2025 conducted by the respondent no.2, within the stipulated time. 3. Learned counsel for Meerut Development Authority placed detailed instructions and states that earlier, various plots/lands were e-auctioned under the MDA Shradhauri Phase-2 Housing Scheme, Sector and Pocket C, Meerut; however, somehow the said bidding process was cancelled. Thereafter again e-auction proceeding was initiated for LMCP-8, wherein, the petitioners were the highest bidder but as the instant bid was lower than the previous bid in the earlier auction proceeding, the Meerut Development Authority has decided not to carry forward with the said auction proceeding and the requisite amount deposited by the petitioners (bidder) has also been remitted in their account. In this backdrop, he submits that once the auction proceeding is cancelled, there is no scope for allotting the plot. 4. Confronted with this situation, learned counsel for the petitioners prays that the present writ petition may be dismissed as not pressed with leave to participate in the fresh bid, if any. 5. Prayer made is allowed. 6. The writ petition is dismissed as not pressed with the aforesaid liberty. Order Date :- 14.7.2025 A.
