1. The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 387/2024, registered
2 at Police Station Baloda, District-Janjgir-Champa (CG) for the offence punishable under Section 103(1), 105, 61(2), 3(5) of BNS,
2023. 2. The prosecution story in brief, is that, since the allegation against the present applicant is that the applicant along with co-accused Rajni Shandil made a conspiracy and mixed the poison in the wine and get the same to Rupesh Shandey and Shiva Banjare. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 29.10.2024, charge sheet has been filed and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Basant Aditya involved in Crime No. 387/2024 under Section 103(1), 105, 61(2), 3(5) of BNS, 2023 at Police Station-
3 Balod, District- Janjgir-Champa (C.G.) is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8.
