ORDER This Revision Petition has been filed challenging the
order passed by the Family Court, Kozhikode in M. C. No.264/2012.
2. The 1st petitioner is the wife and the 2nd petitioner is the son of the respondent. The petitioners filed a maintenance case against the respondent claiming maintenance at the rate of ₹10,000/- each per month. The Family Court after the trial, granted a monthly maintenance of ₹2,500/- (Rupees Two thousand and five hundred only) to the 1st petitioner and ₹2,000/- (Rupees Two thousand only) to the 2nd petitioner. Dissatisfied with the quantum of maintenance, the petitioners have approached this Court.
3. I have heard the learned counsel for the petitioner.
4. The impugned order was passed on 28.12.2012. This Revision Petition has been filed in the year 2013. Even
2025:KER:25737 RPFC NO.222 OF 2013 4 though twelve years have elapsed, the service of the respondent could not be effected.
5. The last report filed by the Station House Officer, Kottarakara Police Station would show that the respondent left his home and his whereabouts are not known. It is also reported that he was ill and hospitalised at Thiruvananthapuram Medical College Hospital twice. Considering the fact that the impugned order is of the year 2012, this Revision Petition is disposed of with liberty to the petitioners to approach the Family Court with an application for modification of the maintenance granted to the petitioners vide the impugned order under Section 127 of the Criminal Procedure Code.
