The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the entire proceedings of Complaint Case No. 2243 of 2022 (Syed Anvar Ali Rizvi vs. Smt. Khalida Anjum and others), under Sections 323, 504, 427 IPC, P.S. Qila, District Bareilly as well as cognizance/summoning order dated 05.01.2025, pending in the court of Additional Chief Judicial Magistrate, Court No. 3, Bareilly. Learned counsel for the applicant fairly admits that the matter is related to husband and wife, who are residing in the same house and 09 other cases are pending between the parties. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
