Neutral Citation No. - 2025:AHC:110238 Court No. - 4 Case :- WRIT - A No. - 9262 of 2025 Petitioner :- Lucky Respondent :- The State Of U.P. And 8 Others Counsel for Petitioner :- Atipriya Gautam,Saundraya Giri,Sr. Advocate,Vinod Kumar Mishra Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner seeks a writ of mandamus commanding the respondent authorities to issue joining letter. It is contended on behalf of the petitioner that the Character Certificate regarding petitioner is still pending at the stage of District Magistrate and unless Character Certificate is issued petitioner cannot be appointed. It is further contended that there was a criminal case against the petitioner in which final report has been submitted on 01.10.2019. Petitioner was never issued any warrant of arrest nor was issued any summoning order from the court of law. Having heard learned counsel for the respective parties and perused the records, I find here in this case the only aspect involved to be whether petitioner can be issued character certificate or not. In the considered view of the Court the District Magistrate is to issue a character certificate or to reject the same but the District Magistrate cannot remain silent and sit tight over the matter. This petition is thus disposed of with a direction to the District Magistrate, Bijnor to take appropriate decision in the matter of
character certificate of the petitioner as expeditiously as possible positively within a period of six weeks from the date of receipt of certified copy of this order. It is further directed that soon after receiving the Character Certificate from District Magistrate, if any, the competent authority will take next step to process appointment of petitioner and consequential training.
