ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents.

Learned counsel for the petitioner submits that respondent No.3-Tahsildar, Nelamangala Taluk has threatened the petitioner that the bridge constructed by the petitioner across the Nala will have to be removed since there are complaints against the petitioner. Learned counsel has today filed a memo along with photographs and submits that the petitioner has only put up the bridge

after securing permission from the Tahsildar orally. It was informed by the Tahsildar that there is no provision for making such an application and seeking permission. It is submitted that the petitioner has not encroached upon any government property, nor has the petitioner diverted the Nala. The petitioner has put up the bridge to connect two pieces of property which are lying on both sides of the Nala.

Learned Additional Government Advocate submits on instructions that it is true that a complaint was lodged by some persons against the petitioner before the Lokayuktha and the Lokayuktha has directed the Tahsildar to take action in accordance with law. However, the Tahsildar has made a spot inspection and if there is any need to remove the bridge or take action against the petitioner, it will be done only in accordance with law.
4. The submission of the learned Additional Government Advocate is placed on record. Accordingly,

the writ petition stands disposed of, with a direction to respondent No.3-Tahsildar, Nelamangala Taluk, that if there is any need to take action against the petitioner, he shall do it only in accordance with law after issuing notice to the petitioner and affording an opportunity of hearing to the petitioner Ordered accordingly.
Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
