The Court made the following
ORDER :-
A.1 in Crime No.308 of 2024 of Medikonduru Police Station, Guntur District, filed the present application under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023, seeking pre-arrest bail.
2. The said crime was registered for the offences under Sections 115(2), 118(1), 324(2), 79 read with 3(5) Bharatiya Nyaya Sanhita,
2023. Subsequently, after receiving wound certificate, Section 118(2) Bharatiya Nyaya Sanhita, 2023, has been added.

3. Case of the prosecution is that on 17.11.2024 at about 9.30 P.M., A.1 to A.7 went to the house of defacto complainant and attacked him owing to small altercation that took place in a function. All the accused said to have beat the defacto complainant with sticks. The petitioner along with others said to have beat the defacto complainant, who lost his three teeth apart from receiving another laceration.

Learned counsel for the petitioner contends that the petitioner is aged about 27 years and he is a graduate and he is taking coaching for Group – I. He further contends that A.2 to A.5 were already granted bail by the court below. He further contends that the incident is an outcome of petty dispute between the defacto complainant and the accused. As such, he requests this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed the bail application by contending that there is a specific overt act attributed against the petitioner/A.1, who beat the defacto complainant on his mouth, resulting loss of his three teeth. As such, the police added Section 118(2) of Bharatiya Nyaya Sanhita, 2023. Accordingly, he requests this Court to dismiss the application.
6. This court perused the entire material on record. As the petitioner is a young student and if he is arrested and remanded to judicial custody, he will lose his carrier and moreover the incident is an outcome of a petty quarrel between the defacto complainant and the accused.
7. In view of the above facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner/A.1 with the following conditions :-

i. The petitioner/A.1 is directed to surrender before the Station House Officer, Medikonduru Police Station, on or before 17.04.2025 and on such surrender, he shall be enlarged on bail on his furnishing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of Station House Officer concerned; and ii. On such release, the petitioner/A.1 shall appear before the Station House Officer concerned, on every Monday between 10.00 a.m. and 1.00 p.m. till filing of the charge sheet; and iii. The petitioner/A.1 shall not, directly or indirectly, induce, threaten, or promise any person acquainted with the facts of the case to dissuade them from disclosing such facts to the Court or any Investigating or Police Officer and shall cooperate with the investigating officer.
8. Accordingly, the Criminal Petition is allowed.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
