The petitioners have been made accused in connection with Bhandra P.S. Case No. 24 of 2024, Spl. POCSO Case No.35 of 2024, for the offence registered under Section 376D of the Indian Penal Code and Section 6 of POCSO Act, pending in the court of learned Additional Sessions Judge-I- cum-Spl. Judge, Lohardaga. Petitioners and co-accused persons are alleged to have gang raped the prosecutrix. Attention has been drawn towards the statement of the victim recorded during trial. On perusal of which, it appears that she has categorically stated that no occurrence, as alleged, had taken place. She has been declared hostile. In view of the aforesaid fact, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I-cum-Spl.
