Neutral Citation No. - 2025:AHC:110632 Court No. - 34 Case :- WRIT - C No. - 21652 of 2025 Petitioner :- Manju Devi Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Nikhil Kumar,Vagish Yadav Counsel for Respondent :- Bhupendra Kumar Tripathi,C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer:- "(a) issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to finally decide the Recall /Restoration application dated 19.12.2024 filed by the petitioner before the respondent no.2 in case no. 5972 of 2023, computerized case no. T202314360605972 under section 67A of U.P. Revenue Code, 2006 (Manju Devi Vs. Gaon Sabha Kauhadaura) in a time bound manner preferably within a period of one month." It is contended that recall/restoration application is pending in proceedings under Section 67-A of the U.P. Revenue Code, 2006. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Deputy Collector, Madhiyahun, Jaunpur to decide the recall/restoration application dated 19.12.2024 pending in proceedings under Section 67-A of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
