From perusal of the order sheet, it appears that this Court in its order dated 18.10.2016 has mentioned the report of Chief Judicial Magistrate, Shahjahanpur dated 04.10.2016 which shows that the sole appellant, Mahendra Singh has died five years ago but further directed that the report was not submitted after proper enquiry. Therefore, another direction was issued to Chief Judicial Magistrate, Shahjahanpur to submit fresh report after holding proper enquiry with regard to the death of sole appellant. 3. In compliance of order of this Court, a requisition was sent to Chief Judicial Magistrate, Shahjahanpur. 4. As per the office report dated 18.11.2016, Chief Judicial Magistrate, Shahjahanpur has submitted his report dated 09.11.2016 mentioning therein that sole appellant, Mahendra Singh, has died 10 years back. 5. As the sole appellant has died, therefore, present appeal has abated and is accordingly, dismissed as abated.
