Petitioner and respondents are present before this Court. 3. Parties jointly submit that dispute is amicably settled and the terms of settlement are recorded in the joint memo. 4. Joint memo dated 17.09.2025 which is signed by the parties and their respective counsel reads as under: "That in the above case both the parties have settled the matter, thereby the petitioner agreed to pay the cheque amount of Rs 4,00,500/- as full and final settlement. Further the petitioner has already - 3 - HC-KAR NC: 2025:KHC:37206 CRL.RP No. 1338 of 2023 deposited an amount of Rs 40,500/- Vide No.424798/18 as per the order passed in Crl Appeal No.370/2018. Therefore, the petitioner agreed to pay the remaining cheque amount of Rs 3,60,000/- by way of DD dated 16-09-2025 bearing No. 104285, in the name of M/s Niranthara Technologies, wherein the respondent No.1 and 2 are the partners. Wherefore the petitioner and respondents pray that this Hon'ble Court be pleased to accept the above joint memo and dispose off the above Criminal revision petition in terms of the joint memo and consequently acquit the petitioner/accused in the ends of justice." 5. In terms of the joint memo, complainants/respondents are entitled to receive Rs.4,00,500/-. 6. Complainants/respondents submit that they have received Rs.3,60,000/- as mentioned in the joint memo and Rs.40,500/- is to be paid to the complainants/respondents from the deposit which is made before the Court below. 7. Hence the following: ORDER (i) Criminal Revision Petition stands disposed of. (ii) Impugned judgment dated 01.04.2023 passed by LXI Additional Sessions Judge, Bengaluru in Criminal Appeal - 4 - HC-KAR NC: 2025:KHC:37206 CRL.RP No. 1338 of 2023 No.370/2018 and judgment dated 06.02.2018 passed by the XXIV Additional Small Causes Judge, Bengaluru in C.C.No.22027/2016 are modified in terms of the joint memo dated 17.09.2025. (iii) Bail bond stands cancelled. (iv) The amount in deposit before the Court below be released in favour of the complainants/respondents.
