1. In the present bunch of four writ petitions, the challenge is to
order dated 27.04.2017 (Annexure P/1) passed by the Central Administrative Tribunal, Chandigarh (for short, ‘Tribunal’) whereby, the claim of the petitioner(s) that they are eligible for competing for the post of Investigator Grade-II, was declined by the Tribunal.
2. Prayer of the petitioner(s) was that though, as per the qualification required to be eligible for the post in question is certificate/diploma course in computer operation from a recognized institute is not possessed by them but as the petitioner(s) have studied the Computer Operation as a subject while pursuing the studies in Bachelor of Science, they should be treated as eligible for competing for the post in question, which plea of the petitioner(s) was not accepted by the Tribunal hence, the present petitions have been filed by the petitioners.
3. It may be noticed that the same issue has come up for
consideration before this Court in CWP-557-2018 titled as Raj Kumar Mishra vs. Union of India and orders, decided on 13.08.2025 wherein, it AARTI SHARMA 2025.08.29 16:55 I attest to the accuracy and integrity of this document
CWP-28712-2017 (O&M) & -3- connected cases has been held that the qualification of certificate/diploma in computer operation or software from a recognized institution is must and the same cannot be treated equivalent to the subject which was studied while pursuing the academic qualification. Relevant paragraph of the said judgment is as under:-
“7. At this stage, learned counsel for the petitioner argues that the petitioner has also studied the computer subject while pursuing his degree of M.Sc. It may be noticed that any subject studied while pursuing the post graduations can not be considered as a specific qualification which has been asked for in a specific manner in the advertisement dated 18.10.2014. Hence, studying a computer subject while undergoing post graduation cannot be treated as equivalent to the certificate/diploma course in Computer Operation or Software from a recognized institute.”
4. Even otherwise, no one has put in appearance on behalf of the petitioners(s) and as a period of 10 years have elapsed since the recruitment has been made and finalized, the petitioner might not be interested in pursuing the present remedy hence, the present writ petitions are dismissed for non-prosecution.
5. Civil miscellaneous application pending, if any, is also disposed of.
6. A photocopy of this order be placed on the file of connected case.
