In this writ petition, petitioner is assailing the e-tender Notification dated 10.12.2022 (Annexure-G) and the short term e tender publication issued during January, 2023 Annexure-K, issued by the second respondent, as illegal and void. 4. Having taken note of the submissions made by the learned counsel appearing for the parties, it is forthcoming from the writ petition, that the petitioner has filed Com.O.S.No.46/2022 before the Principal District and Sessions Judge at Mysuru against the respondent Nos.2 and 3 herein, and the said suit is pending consideration. 5. It is also submitted by the learned counsel appearing for the respondent Nos.2 and 3 herein, that the petitioner herein - 4 - HC-KAR NC: 2025:KHC:52342 WP No. 3577 of 2023 has been removed from the place of business and allottees have taken possession. 6. In that view of the matter, it is open for the petitioner to agitate his rights in appropriate / pending proceedings before the competent Court for redressal of his grievances, if any. 7. All contentions of the parties in the suit are kept open. 8. With the above observation, the writ petition is disposed of. 9. Consequently, I.A.1/2023 does not survive for consideration.
