Neutral Citation No. - 2025:AHC:110308 Court No. - 34 Case :- WRIT - C No. - 21705 of 2025 Petitioner :- Asha Ram And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Om Prakash Gupta Counsel for Respondent :- Azad Rai,C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer:-
"A. Issue a writ, order, or direction in the nature of Certiorari / quashing the impugned order dated 03.05.2025 passed by respondent no. 2 under section 24 of U.P. Revenue Code 2006. B. Issue a writ, order, or direction in the nature of Mandamus restraining the respondents to not interfere in raising construction of the old house and bathroom of petitioner in view of report dated 30.05.2025 submitted by Revenue inspector Tehsil Soraon District prayagraj." It is contended that proceedings under Section 24 of U.P. Revenue Code, 2006 have been initiated by respondent no.4 in which an interim order has been passed on 03.05.2025. Petitioner is aggrieved by the interim order granted in proceedings under Section 24. However, learned counsel contends that he is not pressing the prayers made in writ petition and is only confining for direction to conclude the proceedings under Section 24. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondent, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon authority concerned to conclude the proceedings initiated under Section 24 of the U.P. Revenue Code, 2006, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
