By way of this petition, the petitioner has prayed for the following reliefs; “16. … [A.] Your Lordship may be pleased to admit and allow this Application; [B.] Your Lordship may be pleased to review the order dated 05.12.2024 passed in Special Civil Application No. 14606 of 2023, in light of facts which were not placed before at Annx : A” [C.] Your Lordship may be pleased to pass such further and other orders as may be deemed just, fit and proper in the facts and circumstances of the present case.” 2. Learned Advocate, Mr. Chaudhary, submitted that as the original petitioner – the opponent herein is suffering from cancer, he could not turn-up for joining the duties and C/MCA/1544/2025 ORDER DATED: 27/11/2025 he does not have any objection, if, the main petition is restored to its original file by recalling the order dated 05.12.2024. 3. Learned AGP, Mr. Davda, appearing for the Respondent-State, however, showed an apprehension that even if, the main matter is restored, the petitioner may continue the ‘Contempt Proceedings’. 3.1 In response to the above, learned Advocate, Mr. Chaudhary, under the instructions, submitted that the petitioner will not press for hearing of the application for contempt, during the pendency of the main matter. 4. Heard. In view of the above statement made by learned Advocate, Mr. Chaudhary, at Bar, this application is allowed and the main matter, i.e. Special Civil Application No. 14606 of 2023, is restored to its original file. 4.1 Miscellaneous civil application for restoration stands disposed of, accordingly. 4.2 Registry to list the main matter, i.e. Special Civil Application No. 14606 of 2023, for hearing on 11th December, 2025.
