Heard Sri Pankaj Dwivedi, learned counsel for applicant and Sri Alok Sharma, learned AGA for State. 2. This is second bail application filed by applicant-Roop Singh in Case Crime No. 300 of 2018, under Sections 376, 506, 313 IPC and 5(J) of POCSO Act, Police Station Mangalpur, District Kanpur Dehat. 3. The case is arising out of POCSO Act. During trial out of five proposed witnesses, three have been examined including the victim. 4. Learned counsel for applicant by referring the statement of victim submits that it may be a case of false implication though he is not able to deny that victim has made specific allegation of rape against applicant. Learned counsel further submits that applicant is in jail since 21.08.2024, i.e., for a period of about 11 months. 5. Learned AGA has opposed the prayer for bail and submits that statement victim is consistent against applicant. 6. As referred above, it is the specific case of victim that applicant has committed offence of rape. So far as argument with regard to false implication is concerned, it will be a subject matter of trial. Applicant is in jail for about 11 months, which cannot be considered as a prolonged detention, therefore, no case of bail is made out. 7. The application is accordingly rejected.
