DATED 03.05.2025 (ANNEXURE-D), AS ILLEGAL AND VOID ON THE FILE OF THE RESPONDENT POLICE.
THIS PETITION, COMING ON FOR ADMISSION, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM
ORAL ORDER The petitioner has filed this petition seeking quashing of the entire proceedings in Spl.C.No.962/2025 for offences punishable under Sections 64, 318(4), 351, 352 of Bharatiya Nyaya Sanhita, 2023.
2. Today, an application is filed under Section 359 of the Bharatiya Nyaya Suraksha Sanhita,
2023. Respondent No.2/complainant is present before this Court. Upon enquiry, she submits that she was in a consensual relationship with the accused and that their long-standing association was entirely voluntary. She further states that, at the intervention of elders, family members, and well- wishers, the parties have amicably resolved their dispute, and in that backdrop, she is not inclined to prosecute the

proceedings pending in Spl.C. No.962/2025 (arising out of Crime No.46/2025).
3. On specific query by the Court, respondent No.2 submits that no one has exerted any undue influence, coercion, pressure, or threat upon her and that, of her own volition, she has decided to give a quietus to the dispute. She therefore requests that the proceedings be quashed so as to maintain cordial personal and professional relations with the accused.
4. In view of the withdrawal of all allegations by the complainant, this Court is of the opinion that, though the offences in question are not compoundable, the continuation of the criminal proceedings would serve no fruitful purpose and may amount to an abuse of the process of law. Hence, to prevent abuse of process and to secure the ends of justice, this Court considers it appropriate to quash the proceedings.
