Petitioner is arraigned as accused No.2 in the charge sheet filed by Thalaghattapura Police in their Station Crime No.29/2024. 2. Initially, case was registered against unknown persons for the offence punishable under Section 302 of Indian Penal Code (for short 'IPC'), on a complaint lodged by one Smt.Pallavi, wife of deceased Galappa. 3. The charge sheet is filed against 13 accused for the offence punishable under Sections 114, 143, 144, 147, 148, 120B, 302 and 324 r/w 149 of IPC. - 3 -

4. It is the case of prosecution that, on account of previous enmity, on 28.01.2024 in between 11 a.m. to 1 p.m., all the accused formed an unlawful assembly and came near an under construction building situated on R.V. College Road, Chikke Gowdanapalya, BSK 6th Stage, 4th Block, Bangalore City, committed the murder of Galappa by assaulting him with lethal weapons all over the body. 5. CW2 and CW3 are cited as eyewitnesses. It is submitted by the learned counsel that both the said witnesses are examined before the Trial court, but they have not supported the prosecution case. 6. As per prosecution, accused Nos.1 to 6 are the assailants. The learned counsel for petitioner contended that accused Nos. 1, 4 and 6 against whom similar allegations are made, are enlarged on bail by this Court. Therefore, she seeks to allow the petition and enlarge the petitioner on bail on the ground of parity. - 4 -

The learned HCGP has opposed the prayer, contending that if the petitioner is granted bail, he being a Rowdy sheeter, and having other criminal cases registered against him, may commit similar offences and flee from justice. 8. It is not in dispute that accused Nos.1, 4 and 6 are already been enlarged on bail by this Court. Accused No.1 was granted bail in Crl.P.No.9401/2025 dated 23.07.2025, accused No.4 was granted bail in Crl.P.No.9124/2025 dated 15.07.2025 and accused No.6 was granted bail in Crl.P.No.10120/2025 dated
25.07.2025. The allegations against the petitioner are not different from the one against the said accused, who are granted bail. The petitioner was arrested on 30.01.2024 and he is in judicial custody.
The eyewitnesses, namely, CW2 and CW3 are already examined, hence, question of tampering with the said witnesses does not arise. 9. Considering that similarly placed accused are already enlarged on bail, the petitioner can be admitted to

bail on the same terms and conditions. Hence, the following:-
ORDER
The petition is allowed.
Petitioner/accused No.2 in Crime No.29/2024 of Thalagattapura Police station, pending in S.C.No.265/2024, before the IXth Additional District and Sessions Judge, Bangalore is directed to be released on bail subject to the following conditions:
1. He shall execute a personal bond in sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional court.
2. He shall furnish his residential address and inform the Investigation Officer if there is change with his address.
3. He shall not indulge in committing any offence.
4. He shall not tamper with the prosecution witnesses either directly or indirectly.
5. He shall appear before the Trial Court on every date of hearing the other bail.

If any of the conditions are violated, the prosecution is at liberty to seek cancellation of the bail.
