JUSTICE MOHAMMAD NAWAZ ORAL ORDER Learned HCGP takes notice for the State. 2. Heard both the parties and perused the material on record. 3. Petitioner is arraigned as accused No. 6 in Crime No. 74/2025 of Annapurneshwarinagar Police Station, Bangalore City, registered for the offence punishable under Sections 506, 504, 120-B, 406, 420 r/w 34 of IPC. 4. This petition is preferred praying to enlarge the petitioner on anticipatory bail. 5. In the complaint lodged by one Jayalakshmi, it is alleged that she had taken on lease, the residential premise from the accused persons for Rs.12,00,000/-. The accused collected money from other tenants as well, who were provided with respective residential accommodation - 3 - HC-KAR NC: 2025:KHC:34432 CRL.P No. 12630 of 2025 and thereafter, they were put in possession of their respective properties. It is alleged that the accused thereafter, demanded the tenants to vacate the premises taken on lease and threatened them etc. 6. Accused No.3 had preferred Crl.P.No.7353/2025 and accused Nos. 2, 3 had preferred Crl.P.No.5076/2025 before this Court seeking anticipatory bail. The said petitions were allowed by this Court, granting relief to the said accused. It is observed therein that the dispute between the parties primarily appears to be of civil dispute and the aggrieved parties can approach the jurisdictional Civil Court and seek necessary relief to protect their possession in respect of the premises, which were leased out to them. 7. Petitioner also stand on the same footing as the accused who are granted bail by this Court in the above noted petitions. The complainant has stated, she is suspecting that the petitioner has colluded with other accused to cheat her. At this stage, except the bald - 4 - HC-KAR NC: 2025:KHC:34432 CRL.P No. 12630 of 2025 allegation against the petitioner, no materials are placed against her. 8. Petitioner is a woman. In the facts and circumstances, her custodial interrogation may not be necessary. The offence alleged are not punishable with death or imprisonment for life. Considering that similarly placed accused are granted anticipatory bail by this Court, relief sought in this petition can be granted. Accordingly, the following: ORDER Petition is allowed. Petitioner/accused No.6 in Crime No.74/2025 registered by Annapurneshwarinagar Police Station, is ordered to be released, in the event of her arrest, subject to following conditions: a) She shall appear before the Investigating Officer within a period of ten days from the date of receipt of a copy of this order - 5 - HC-KAR NC: 2025:KHC:34432 CRL.P No. 12630 of 2025 and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with a surety for the likesum. b) She shall furnish proof of her residential address and shall inform the Court, if there is change in the address. c) She shall co-operate with the investigation of the case. d) She shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) She shall be regular in attending the Court proceedings.
