GP FOR HOME The Court made the following order: This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “to issue an appropriate Writ Order or direction more particularly in the nature of Writ of Mandamus declaring the action of the Respondents No 2 to 4 in interfering with the civil dispute despite the pendency of the suit O S No 171 of 2023 filed for cancellation of alleged sale deed dt 24062020 vide Document No 2472/2020 regarding land an extent of Ac 2 0 82 cents and Ac 0 18 cents in Sy Nos 462/2 and 462/4 total an extent of Ac 1 00 cents of Adivi Grama Panchayat Narasaraopet Revenue Division Bapatia is illegal arbitrary capricious and violative articles 14 21 and 300A of Constitution of India Consequently direct the Respondents Nos 2 to 4 not to interfere with the civil disputes between the Petitioner and 5th and 6th Respondents including threatening for settlement and pass such...” 2. Heard learned counsel for the petitioner and learned Additional Government Pleader appearing for the State. 3. Learned Additional Government Pleader appearing for the State on written instructions would submit that basing on the report of the petitioner, the Police conducted preliminary enquiry which would reveal that it is a civil dispute between the parties and as such they will not interfere with the civil dispute and all the other allegations made in the affidavit are not true and correct. 4. Submissions made by learned Additional Government Pleader are placed on record. 5. In that view of the matter, this Court is of the considered opinion that the Writ Petition can be closed at the stage of admission itself, without going into merits of the case, by directing 3 the respondent/Police to follow due procedure established under law. 6. Accordingly, Writ Petition is closed. No order as to costs. Interlocutory applications, if any, pending shall stand closed. _____________________________ JUSTICE B.V.L.N.
