Neutral Citation No. - 2025:AHC:134094 Court No. - 5 Case :- WRIT - B No. - 2573 of 2025 Petitioner :- Smt. Shweta Pandey And 3 Others Respondent :- Board Of Revenue Up And 7 Others Counsel for Petitioner :- Digvijay Tiwari,Ramendra Asthana Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J.
1. Heard S/Shri Ramendra Asthana and Digvijay Tiwari,
learned counsel counsel for the petitioner.
2. This Court by a detailed judgment dated 07.11.2025 has dismissed Writ-B No. 3781 of 2014 filed by one Asif Iqbal. The present petitioners were respondents therein.
3. It has been rightly pointed out by Shri Ramendra Asthana that in the aforesaid judgment, the Court has taken note of the
order dated 03.05.2018, however, still a revision petition filed on behest of one of the close relative of one of the writ petitioners and without taking note of the aforesaid judgment passed by this Court, an order dated 28.05.2025 was passed by the Board of Revenue and an interim order has also been passed, which on the face of it is an illegal order being a step to over reach a judgment passed by the Court.
4. Shri Ramendra Asthana, learned Advocate also refers that objections filed by the petitioner herein before the Board of Revenue specifically referred about judgment dated 07.11.2024 passed by this Court. A copy of the same was also annexed, still the Board of Revenue has not taken note of it and no attempt was taken either to accept it or distinguished it in the given facts and circumstances.
5. In the aforesaid facts and circumstances, even without issuing notice to the respondents, a case of interference is made out and the impugned order is set aside and the matter is remanded to the Board of Revenue to pass a fresh order within two weeks, after taking note of the judgment passed by this Court, i.e. whether revision petition is maintainable or not after hearing rival parties.
6. The writ petition stands disposed of with the above observations and directions.
7. Registrar (Compliance) to take steps.
