During the course of the trial, FSL report has been obtained by the trial Court in respect of certain signatures. On the strength of the opinion rendered therein, the case of the petitioners is that the proceedings against them has to be quashed. 3. It is well established principle of law that, the Court can take the help of experts in analysing technical aspects. 4. Section 45 of the Indian Evidence Act, 1872 reads as under:- "45. Opinions of experts.- When the Court has to form an opinion upon a point of foreign law or of science or art, or as to identity of handwriting or finger impressions, the opinions upon that point of - 5 - HC-KAR NC: 2025:KHC:48221 CRL.P No. 8734 of 2023 persons specially skilled in such foreign law, science or art, or in questions as to identity of handwriting or finger impressions are relevant facts. Such persons are called experts." 5. It is also well established in law that the opinion of experts rendered under Section 45 of the Indian Evidence Act, 1872, is not binding on the Court. The Court is always at liberty to differ from the same by giving proper reasons. Under the said circumstances, the question of quashing the proceedings solely based upon the FSL report does not arise. Whether the petitioners are guilty of the offences alleged or not has to be established by the prosecution during the trial. 6. It is not contented by the petitioners that the facts alleged do not constitute an offence against the petitioners. 7. For the aforementioned reasons, the petition stands dismissed.
