JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking quashment of the proceedings in C.C.No.3221/2024 registered for offences punishable under Sections 498A, 323, 504 and 506 of the IPC and Section 4 of the Dowry Prohibition Act, 1961. - 3 - HC-KAR NC: 2025:KHC:25449 CRL.P No. 2203 of 2024 2. Heard Sri. Syed Jaffer Mohiyuddin, learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl.SPP appearing for respondent No.1, Sri. Nagaiah, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the aforesaid proceedings, the parties were also before the concerned Family Court in M.C.No.5530/2024 and have settled all the dispute between the two. One such condition of such settlement is the closure of the present proceedings. The said condition reads as follows: "11. The respondent has no objection in granting a decree in G & WC No.315/2024 pending on the file of II Addl. Family Court, Bengaluru in terms of this agreement and The petitioner shall file the no objection affidavit in Crl.P.No.2203/2024 pending before the Hon'ble High Court of Karnataka to quash the Crime No.141/2023 and C.C.No.3221/2024 filed under section 498A filed by the petitioner against the respondent and his family members pending on the file of 39th ACJM, Bengaluru in view of this agreement. 12. The respondent undertakes not to precipitate the B' report filed by the New Tumkur Police Station in Crime No.27/023. 13. Both the Parties admit and agree that there is no collusion or force, fraud and undue influence in agreeing/ settling the aforesaid terms and conditions and entering into this Agreement in the aforesaid manner." - 4 - HC-KAR NC: 2025:KHC:25449 CRL.P No. 2203 of 2024 4. In the light of the settlement arrived at between the parties and one of the conditions of the settlement or terms of settlement being closure of the present proceedings and the same being accepted by the petitioner and respondent, I deem it appropriate to quash the proceedings qua the petitioner in the subject petition. 5. For the aforesaid reasons, the following: ORDER (i) The petition stands disposed. (ii) Proceedings pending in C.C.No.3221/2024 before the XXXIX Additional Chief Metropolitan Magistrate (ACMM) Court, Bangalore, stands quashed qua the petitioner.
