Ms. Manisha Rana Singh, D.A.G. for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in Sessions Trial No.51 of 2019, State Vs. Rajeev Kumar, arising out of FIR No.639 of 2018, under Sections 302 and 201 IPC, Police Station Rudrapur, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused. 3. This is the third bail application. The first bail application, being BA1 No.3237 of 2021, was dismissed as withdrawn on 24.04.2024. The second bail application, being BA2 No.333 of 2024, was dismissed as withdrawn on 18.02.2025. 4. It is argued by learned counsel for the applicant that it is a case based on circumstantial evidence; the applicant is in custody for more than 6 and a half years; he 2 was arrested on 31.11.2018; out of 26 witnesses, till date, only 9 witnesses have been examined; there are less chances of trial being concluded in near future. 5. Learned State Counsel admits these facts. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
