This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 336, 420, 467, 468, 471, 120-B & 34 of IPC and Section 41 of the Clinical Establishment Act. 3. It is alleged against the petitioner that he is having a forged degree of MBBS and he is providing medical treatment in Occupational Health Centre, which is not registered under Clinical Establishment Act. 4. Learned counsel for the petitioner submits that at no point of time petitioner had treated any person. The petitioner had arranged staffs, nurses and Doctors and equipment only. He further submits that the plant Manager and others have been enlarged on anticipatory bail. 5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 6. From the case-diary, I find that there is no allegation that the petitioner has treated anyone. Some purchase orders were made by the petitioner which were duly supplied. 7. Since there is no allegation against the petitioner that he has treated any patient. This Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and 2025:JHHC:13809 on the event of her surrender or arrest, she shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur, in connection with Govindpur P.S. Case No.35 of 2023, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
