Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 06/02/2025 1. By way of this petition, the petitioner has prayed for following reliefs:- “I. May this Hon'ble Court be kind enough to call for the entire records pertaining to the case of the Petitioner. II. May this Hon'ble Court be kind enough to quash the Seniority List dated 01.04.2023 issued by Respondent No. 4 whereby the seniority of Petitioner is considered from the date of transfer in the Office of Respondent No. 4 instead of considering it from the date of her initial appointment i.e. from 22.04.2013 even after being transferred through administrative order. III. May this Hon'ble Court be kind enough to issue appropriate writ/order/direction to Respondent No. 4 to consider the case of the Petitioner and count her seniority from the date of her initial appointment i.e. from 22.04.2013. 3 IV. May this Hon'ble Court be kind enough to issue appropriate writ/order/direction to Respondent No. 3 to act upon the letter dated 24.09.2024 issued by the Deputy Director, Directorate of Public Education directing Respondent no. 3 to determine the seniority and promotion of the Petitioner at the earliest. V. May this Hon'ble Court be kind enough to grant any other relief that this Hon'ble Court may deem fit in the interest of justice.” 2. Though the learned counsel for the petitioner has prayed several reliefs but at this stage learned counsel for the petitioner prays that the District Education Officer, District-Koriya, Baikunthupur, Chhattisgarh may be directed to consider the claim of the petitioner for promotion to the post of Assistant Grade- II and for this a memo dated 24.09.2024 has already been issued by the Deputy Director, Directorate of Public Education, Chhattisgarh, however, till date it has not been considered as such the respondent No. 3- District Education Officer, District-Koriya, Baikunthupur, Chhattisgarh may be directed to consider the same and to pass appropriate orders in respect of promotion of the petitioner. 3. On the other hand, learned counsel for the State opposes the same. 4 4. The respondent No. 3- District Education Officer, District-Koriya, Baikunthupur, Chhattisgarh is directed to consider the case of the petitioner for promotion and to pass appropriate orders in respect of promotion of the petitioner and to include the name of the petitioner in the seniority list if she is found to be fit for promotion. 5.
