By means of the present petition under Article 227 of the Constitution of India, the petitioner has prayed the following prayers: "i. Setting aside the impugned order dated 08.11.2024 passed by the learned Additional Sessions Judge, POCSO Act, Bijnor in Criminal Revision No. 53 of 2024 (Himanshu Chaudhary Vs. State of U.P. and others). ii. Setting aside the order dated 08.02.2024 passed by Additional Civil Judge (Junior Division)/Judicial Magistrate, Court No. 5, Bijnor in Complaint Case No. 2840 of 2021 (Sudesh Kumar Vs. Himanshu Chaudhary) under Section 138 N.I. Act, Police Station-Kotwali, District-Bijnor." It has been submitted by learned counsel for the petitioner that the learned Trial Court vide order dated 08.02.2024 had granted him the relief to submit the report of the Handwriting Expert subject to the payment of Rs.2,000/- as compensation. From the perusal of record, it transpires that the trial is at the advance stage, however, in the interest of justice, the order dated 08.02.2024 is hereby affirmed and the petitioner is directed to pay the compensation of Rs.2,000/- and shall accordingly submit the Handwriting's Expert report at the earliest. With the aforesaid direction, the petition is allowed. In the meantime, no coercive measures shall be taken against the petitioner.
