Mr. Shibjit Mitra, Mr. Shibashis Chowdhury …for the Petitioners Mr. Subha Pathak, Mr. Tamal Singha Roy …for Respondent Nos. 9 to 16 The petitioners allege that respondent nos. 9 to 16, who are members of the local club known as Millennium Club, cause obstruction to the ingress and egress from the petitioners’ residential premises during the performance of various festivals, including Durga Puja, Shyama Puja, and Saraswati Puja. The learned advocate appearing for respondent nos. 9 to 16, however, submits that the said pujas are organized and performed by the local villagers at large. It is further submitted that the plots of land where the festivals are held are not exclusively owned by the petitioners; rather, the said plots are jointly owned by the Indian Railways, the Public Works Department of the State, and others. No specific allegation has been made against the concerned Gram Panchayat so as to render this writ petition maintainable before this Court. The dispute, as it appears, is private in nature and does not involve any 2 element of State action. In view of the aforesaid, I am not inclined to entertain the present writ petition. This order, however, shall not preclude the petitioners from approaching the competent civil court or any other appropriate forum for redressal of their grievance in accordance with law. Accordingly, WPA 2624 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
