Heard, learned Advocate, Mr. Chirag Aaydi, for learned Advocate, Mr. Soni, for the petitioners and learned AGP, Ms. Pandya, for the Respondent-State. 2. By way of this petition, the petitioners have prayed for the following reliefs; “8. … A) Your lordship may be to admit / allow this Petition; B) Your lordship may be pleased to issue appropriate writ, order or direction upon the concerned respondent authority to C/SCA/15144/2025 ORDER DATED: 24/11/2025 decide application / objection of the petitioner dated 30.09.2025 as well as issue direction upon the concerned respondent authority to consider the objection of the petitioners as well as guideline dated 15.01.2009 while preparing final seniority list. C) Your lordship may be to pass such orders as though fit in the interest of justice.” 3. Learned AGP, Ms. Pandya, produced on record a communication dated 21.11.2025, received from the Development Commissioner, State of Gujarat, Gandhinagar, wherein, it is stated that in respect of Seniority List dated 12.09.2025, certain objections were raised by the petitioners, which shall be considered by the Respondent- authorities and thereafter only, the Final Seniority List will be published. 3.1 Additionally, under the oral instructions received from one Mr. Piyush Rajvanshi, Under Secretary, Panchayat Department, learned AGP, Ms. Pandya, submitted that on publication of the final Seniority List, the same will not be acted upon and no promotion will be granted on the basis of C/SCA/15144/2025 ORDER DATED: 24/11/2025 the same for the period of seven days, from the date of publication, thereof. 4. In view of the above developments, at this juncture, keeping all the rights and contentions of the petitioners open, learned Advocate, Mr. Aaydi, for learned Advocate, Mr. Soni, seeks permission to withdraw this petition, as the same was preferred against the provisional seniority list. 5. In view of the above, permission, as prayed for, is granted. This petition stands disposed of, as withdrawn. It is clarified that this Court has not examined the merits of the matter.
