Learned AGA accepts notice for respondent Nos.1 and 2. 2. The petitioner is before this Court seeking for the following reliefs: i) Issue Writ in the nature of mandamus directing the respondent No.2 to remove the name of the petitioner in the list of rowdy sheeter. In view of the order dated 07.08.2024 in W.P.No.17966/2024 as per Annexure-F and order dated 07.11.2024 in W.P.No.28391/2024 as per Annexure-G. ii) Issue such other appropriate order or direction as this Hon'ble Court may deem just and fit in the circumstances of the case. - 3 - HC-KAR NC: 2025:KHC:44120 WP No. 24027 of 2025 3. The petitioner's name had been included in the rowdy sheeter list on the ground that there are eight criminal proceedings which had been filed against the petitioner as on 2003, the said rowdy sheet was opened in Crime No.345/2003. 4. The submission of learned counsel for the petitioner is that the said rowdy sheet entry continues to be in force even till date when all the eight criminal proceedings which had been filed against the petitioner have ended in the acquittal of the petitioner. 5. Learned AGA would, however, submit that even though those cases have ended in acquittal, there is a Preventive Information Report (PIR) which has been registered on account of certain small skirmishes, which have not resulted in any crime being registered. - 4 - HC-KAR NC: 2025:KHC:44120 WP No. 24027 of 2025 6. Having heard both the counsels, the opening of a rowdy sheet would have to be on the basis of any proceedings, which are pending and or on account of any conviction, which has occurred on the ground that despite conviction and release of the prisoner, there is a possibility of further offences being committed. 7. In the present case, all the eight cases, which had been filed against the petitioner having ended in acquittal, the prosecution not being successful in prosecuting those matters. In my considered opinion, the question of continuing the rowdy sheet without any further crime being registered could not arise. 8. In that view of the matter, I proceed to pass the following; ORDER i. Writ petition is allowed. - 5 - HC-KAR NC: 2025:KHC:44120 WP No. 24027 of 2025 ii. A mandamus is issued directing respondent No.2 to consider the representation of the petitioner and remove the name of the petitioner from the list of rowdy sheeter within a period of 30 days from the date of receipt of a copy of this order.
