Even though the learned Senior Counsel appearing for the petitioner as well as the learned Senior Counsel appearing for the 5th respondent made elaborate submissions, including with respect to the previous sale deed, this Court refrains from making any observations, as the suit is presently pending between the parties and any such observation may prejudice their respective rights. 3. Therefore, this Court is not inclined to set aside the impugned order. The rights of the parties shall be adjudicated in the pending suit. The Trial Court is directed to consider and dispose of the suit on its own merits, uninfluenced by any observations made by the revenue authorities.
