Neutral Citation No. - 2025:AHC:108319-DB Court No. - 40 Case :- WRIT - C No. - 21485 of 2025 Petitioner :- Smt. Urmila Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Jahnavi Tripathi,Kumdax Kumar Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Jayant Banerji,J. Heard Ms. Jahnavi Tripathi, learned counsel for the petitioner and Sri Rajeshwar Tripathi, learned Chief Standing counsel for the State. This petition has been filed with the prayer to command the respondents to grant six months additional time for disposing off sand stored on the plot of the petitioner for which storage license was granted by the competent authority in her favour. Learned counsel for the petitioner points out that a spot inspection was conducted by the authorities of the State and additional liability was fixed upon her to pay a sum of Rs.55,88,720/-. This amount has been deposited by the petitioner within the time extended pursuant to a direction issued by this Court. Grievance of the petitioner is that within the limited time allowed by the authorities i.e. 45 days, the petitioner has not been able to sell the stored sand on the plot in question. Applications apparently have been moved before the authority for grant of additional time to dispose of the stored sand. It is in this context that petitioner has approached this Court for a direction upon the authorities to pass appropriate orders on the petitioner's pending application for extension of time to sell the stored sand. Learned Standing counsel has obtained instructions from the District Magistrate, Basti according to which the petitioner has not been able to sell sand despite grant of time by the District Magistrate, Basti. Be that as it may, considering the fact that huge quantity of sand is stored on petitioner's plot for which storage license is undisputedly issued to the petitioner, we are of the view that District Magistrate, Basti in the facts and circumstances is required to take an appropriate decision on the petitioner's application for extension of time to dispose of the sand. Without commenting on the merits of the petitioner's claim, we dispose of this petition with a direction upon respondent no.3 to accord consideration to petitioner's application by passing appropriate order, in accordance with law, within a period of four weeks, from the date of presentation of certified copy of this order.
