2. The grievance of the petitioners is two folded, (1) that pursuant to the orders passed by this Court in WP

HC-KAR NC: 2025:KHC:32707 WP No. 22844 of 2025 No.12114/2009 dated 29.06.2010 setting aside the order of confirmation of bid in favour of the petitioners herein, the Deputy Commissioner was directed to re-auction the property in question, however neither re-auction is conducted nor the amount deposited by the petitioners have been returned to them.

The prayer in this writ petition is to direct the respondents to re-auction the property in question in terms of the orders passed in WP No.12114/2009 and to direct the respondents to return a sum of ₹2,75,000/- (Rupees Two Lakh Seventy-five Thousand only) deposited by the petitioners along with 18% interest per annum calculated from 29.06.2010 till the date of realization.
4. Having regard to the passage of time from the date of the order passed by this Court and the fact that the writ petition has been filed in the year 2025, this Court is of the considered opinion that no directions can be issued to the respondents to re-auction the property.

Accordingly, the writ petition stands disposed of with a direction to the second respondent - Deputy Commissioner, Bengaluru Urban District to refund the said amount of ₹.2,75,000/- (Rupees Two Lakh Seventy-five Thousand only) to the petitioners along with admissible interest in accordance with law. The amount shall be returned to the petitioners as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order.
