This anticipatory bail application under Sections 482 & 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 33, 41 & 42 of Indian Forest Act and Sections 4, 5 & 6 of Forest Products Act. 3. It is stated that from a saw mill some logs of sal woods were recovered. It is alleged that the saw mill belongs to this petitioner. 4. Learned Spl.PP. representing the State opposes the prayer for anticipatory bail. 5. In this case, cognizance has been taken and thereafter, now non-bailable warrant of arrest has already been issued. 6. After going through the documents, I find that the main allegation is that this saw mill belongs to this petitioner. There is no specific evidence in support of the aforesaid statement. The petitioner denies the ownership of any saw mill. 7. Considering the fact that the petitioner is denying the ownership of saw mill and there is no document to suggest that the saw mill belongs to the petitioner and also the fact that the cognizance has already been taken, I am inclined to allow this anticipatory bail application. 8. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of her surrender or 2025:JHHC:21362 2 arrest, she shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Giridih in connection with Forest Case No.195/2016, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property. The petitioner should appear and file his bail bond before the concerned Court within three weeks and will also file an undertaking that he will appear before the trial Court as and when directed and will cooperate in the trial.
