ORDER: This Crim'lnal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking bail in cr.No.03/2025 of Markapuram Rural Police Station, Prakasam District. 2. A case has been registered aga'lnSt the Petitioner and Others fOrthe offence punishable u/Sec.103(1 ),109(1 ) r/w 61 (2) of B.N.S.
3. Case of the prosecution, in brief, iS that, the defaCtO COmPlainant namely E.Subbalakshmamma is a resident Of Markapur Town. She got married to A3 who belongs to K.Kothapalli Village and was blessed with a son and a daughter. A3 had two brothers i.e. A1 & A2. Al was convicted and had undergone nine years of imprisonment and released on 2019. There were some family disputes With regard tO the Vehicle Purchased by Al and A2, which was later sold away. After release of A1, A2, who is his brother, complained badly against the defacto complainant. Then she shifted to Markapuram along with her son and daughter in law. Thereafter, Al and A2 used to insult her and threaten With dire consequences. On o9.01.2025, the defacto complainant along With One Radhanjali went to Kothapalli village on Scooty and at 6.00 pm, when they reached Bheemunipadu village, One tipper lorry belongs tO A2 crossed them and '\ eisT\ ty-.I>-. when they were near factory, Al hit them with that tipper lorry and dragged 'them resulting in death of said Radhanjali on the spot and the defacto complainant sustained grievous injuries. Al fled away from the spot. police recorded the stat'ement of the defacto complal-nant and registered the same as above and arrested Al to A3 on 13.01.2025 and got remanded them to judicial custody. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is at crucial stage and opposed the bail application. 6. A perusal of the material available on record goes to show that all the allegations are directed against A1. He is alleged to have dashed the defacto complainant when she was going on a Scooty. The accusation that has been made against the petitioner herein I'S that he iS the owner Of the tipper. Except the said allegation, there is no other material to connect the petitioner with the crime. The petitioner was arrested on 13.01.2025 and since then he is in judicial remand. 7.
ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner/A2 herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Markapur; ~/ t--ct``¥
