Both the learned counsel for the petitioner as well as for respondent Nos.1 and 2 together submit that C.C.No.30/2019 is pending on the file of the Special Court for Economic Offences, Bengaluru. During the pendency of the proceedings, a compounding application has been filed by the petitioner, which has been accepted by the respondents in terms of the provisions of the Companies Act, 2013. It is further submitted that the required formalities as per the Companies Act shall be completed by both the petitioner as well as for respondent Nos.1 and 2. In the light of the same, it is submitted that the petition may be dismissed as having become infructuous. 2. The submission of both the learned counsel for the petitioner as well as for respondent Nos.1 and 2 is placed on record. 3.
