JUSTICE ANIL KUMAR SINHA ORAL ORDER 2 10-09-2025 1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. This application, for grant of anticipatory bail, arises out of Chhauradano Police Station Case No. 37 of 2025, dated 14.02.2025, disclosing offences under Sections 338/336(3)/340(2)/318(4)/317(4)/317(5)/3(5) of the Bhartiya Nyaya Sanhita. 3. The prosecution case, as per the First Information Report, is that on 13.02.2025, while patrolling, the informant received information from local chowkidar of village Bela Chamahi that co-accused Harchan Mahto has stolen a pickup van and he is using it by changing its registration number with the help of the petitioner. When the police Patna High Court CR. MISC. No.61086 of 2025(2) dt.10-09-2025 2/3 reached at the place of occurrence, two persons started fleeing away upon seeing the police party and managed to escape. On enquiry the local chowkidar disclosed the name of the persons who fled away. The police recovered the pickup van, bearing registration no. BR33-J-6066, adjacent to the house of the petitioner laden with straw and no one came to verify its ownership nor produced any valid documents. 4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to oblique motive and village politics. He next submits that allegation against the petitioner is false and fabricated and he has been made accused on the basis of disclosure by local chowkidar with whom the petitioner has inimical terms. He further submits that the petitioner was not present at the place of occurrence and nothing has been recovered from conscious possession of the petitioner and/or from the premises belonging to him. The petitioner has got no criminal antecedent. 5. Regards being had to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that local chowkidar has disclosed Patna High Court CR. MISC. No.61086 of 2025(2) dt.10-09-2025 3/3 the name of the petitioner, who in association with co- accused Harchan Mahto, were using the stolen pickup van after changing its registration number and the vehicle, in question, has been recovered from near his house, I am not inclined to grant the petitioner privilege of anticipatory bail. 6.
