This Criminal Petition, under Sections 480 and 483 of the Bharatiya NagarI'k Suraksha Sanhita, 2023, has been filed by the petitioners/Al and A2, seeking bail, in Crime No.213/2024 of Gudur Rural Police Station, Tirupathi district, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances AIf^. 2. Case of the prosecution in brief, is that on 28.12.2024 at about 4.00 p.m., on receipt of credible information regarding illegal possession and transportatl'on of ganja, the sub-Inspector of Police along with his staff and mediators, proceeded to NH-16, Nellore-Chennai road, in front of Gudur Grand Hotel, Gudur bypass junction and found two Persons trying tO flee from the area upon seeing the police. Then, the police apprehended them and on interrogation, they disclosed their identity particulars as that of Al and A2. Police found 20 kgs of ganja in their possession. Police seized the contraband, arrested the accused and got them remanded to judicial custody on 29.12.2024 and since then they are in judicial custody. 3. Heard. Perused the record. `,.'\ ^., 2
4. Learned Assistant +Public Prosecutor submits tha`€ major part of the I'nVeStigatiOn iS completed and there are no antecedents insofar as the petitioners are concerned. 5.
A perusal of the material available on record goes to show that the Petitioners Were arrested and remanded to judicial custody on 29.12.2024. Police, on credible information, arrested the accused and seized 20 kgs of ganja, which falls under the definition of norl-commercial quantity, from the POSSeSSiOn Of the Petitioners. The petitioners are languishing in jail since
29.12.2024. 6. ln view of the aforesaid facts and circumstances of the case, this Court l's inclined to grant bail to the petitl'oners/Al and A2 herein, on the following conditions. (i) The petitioners/Al and A2 herein sha" be released on bail on their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each with two sureties for a like sum each to the satI-SfaCtiOn Of the learned Additional Judicial Magistrate of First class, Gudur, SPSR Nellore District; (ii) On release, the petitioners shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. (iil') The petitioners h`erein shall not go beyond the jurisdiction of Tirupathi District, Andhra Pradesh State, without leave of the trial Court and they shall make available their location through mobile phone by pairl'ng it with the mobile phone of the Investigating officer round the clock. t.= -..
