JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred by accused No.10 in SC No.5042/2022 pending before the III Additional District and Sessions Judge, Bengaluru Rural District, to enlarge him on bail. 2. Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 3. Case in Crime No.320/2020 of Attibele Police Station, Bengaluru District was registered against the petitioner and others for the offence punishable under section 302 of IPC. - 3 - HC-KAR NC: 2025:KHC:37488 CRL.P No. 12591 of 2025 4. Chargesheet was filed against accused Nos.1 to 12 for the offence punishable under section 302, 120(B), 212, 465, 468, 471 of IPC. 5. It is the case of prosecution that there was a long standing rivalry between the two groups. In the year 2019, one Devaraj, a relative of accused No.1, Ananth Kumar was murdered by a relative of Sunil, by name Vineeth and others. In this background, it is alleged that petitioner, arraigned as accused No.10, while in prison conspired to commit the murder of Vineeth, brother of Sunil. In furtherance of the conspiracy, other accused are alleged to have committed his murder on 30.10.2020 at about 9.00 a.m., by assaulting him with deadly weapons like long and dagger, near DHL Company Gate, Mayasandra, Anekal Taluk, Bengaluru. 6. As per chargesheet allegations, specific overt, acts of assaulting the deceased are against accused Nos.1 to 5. It is alleged that the petitioner while in prison conspired and instigated the other accused persons to - 4 - HC-KAR NC: 2025:KHC:37488 CRL.P No. 12591 of 2025 eliminate Vineeth. The fact that he was in prison, when the incident took place is not disputed by the State. The allegations that he has conspired and instigated the other accused, who executed the plan, is a matter which has to be established during trial. It is submitted that the petitioner was secured under body warrant in this case on 15.12.2020. 7. The learned High Court Government Pleader submitted that the trial has commenced and 12 witnesses are already examined. He contended that if petitioner is enlarged on bail, he may tamper with the prosecution evidence and hamper the case of prosecution. 8. The apprehension of the prosecution can be safeguarded by imposing stringent conditions. For the above reasons, the following: ORDER i. Petition is allowed. - 5 - HC-KAR NC: 2025:KHC:37488 CRL.P No. 12591 of 2025 ii. Petitioner/accused No.10 in S.C.No.5042/2022 pending before the III Additional District and Sessions Judge, Bengaluru Rural District sitting at Anekal (Crime No.320/2020 of Attibele Police Station, Bengaluru City) shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. 3. He shall mark his attendance before Attibele Police Station on every Sunday between 11.00 a.m., and 1.00 p.m., till conclusion of the trial. 4. He shall not directly or indirectly tamper with the prosecution witnesses. - 6 - HC-KAR NC: 2025:KHC:37488 CRL.P No. 12591 of 2025 5. He shall not indulge himself in any criminal activities.
