Issue a writ, order, or direction in the nature of the mandamus commanding the Respondent no.2 to adjudicate and decide the Case no. 369/RST/8487/2015 and Computer Case No. T20150531038487(Smt. Ramawati Devi versus Rajju), Under Sec. 34 Uttar Pradesh Land Revenue Act 1901 in Mauza-Bangaai, Tappa- Khutahan, Pargana Haweli, Tahsil- Sadar, District - Gorakhpur is Pending before Nayab Tahsildar, Pipraich, District Gorakhpur Since 29.9.2015, Within the stipulated period fixed by this Hon'ble court." It is contended that Case No.369/RST/8487/2015 (Computer No. T20150531038487), under section- 34 U.P. Land Revenue Code 1901 is pending consideration before respondent no.2-Nayab Tehsildar, Piparaich, Gorakhpur. The sole prayer made in the writ petition is to expedite the aforesaid case. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondent, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- Nayab Tehsildar, Piparaich, Gorakhpur to decide Case No.369/RST/8487/2015 (Computer No. T20150531038487), under section- 34 U.P. Land Revenue Code 1901, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
