Dutta, learned counsel for the applicant who has filed the instant Interlocutory Application for setting aside the abatement of the appeal, on the demise of the sole appellant i.e. Late. Manoranjan Ray, on his substitution by his legal heirs. Mr. M. Alamgeer, learned counsel for the respondents is present, who submits that he has no objection to setting aside the abatement of the appeal on the substitution of the Late. Manoranjan Ray, by his legal heirs in the connected Test. Case No.1/2009. Accordingly, the instant Interlocutory Application for setting aside the abatement of the appeal on the substitution of Late. Manoranjan Ray, by his legal heirs, namely, a) Smti Sabitri Ray [Wife of Late Manoranjan Ray], b) Ankur Ray [Son of Late Manoranjan Ray], c) Abhijit Ray [Son of Late Manoranjan Ray] and d) Manoj Ray [Son of Late Manoranjan Ray], is allowed and disposed of.
